Application no. 11963/12 Zana YAKTI N against Turkey
The European Court of Human Rights (Second Section), sitting on 24 October 2019 as a Committee composed of:

Having regard to the above application lodged on 5 January 2012 ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Zana Yaktın , was born in 1978.
The applicant was represented by Mr G. Uçar , a lawyer practising in İzmir.
The applicant ’ s complaints under Article 6 § 3 (d) of the Convention, concerning the applicant ’ s inability to confront, question and examine certain witnesses against him before the trial court, were communicated to the Turkish Government (“the Government”) , who submitted observations on the admissibility and merits.
The Registry ’ s letter of 28 September 2018, sent to the applicant ’ s representative, was returned as the representative had moved from the address that had been indicated in the application form. Moreover, the same letter was also sent to the applicant ’ s prison address. This letter was returned by the postal service to the Court with the mention “not known at this address”. No new address for the applicant or his representative has been provided to the Court despite the clear obligation to this effect provided for by Rule 47 § 7 of the Rules of the Court.
THE LAW
In the light of the foregoing, the Court concludes that the applicant does not wish to pursue the application within the meaning of Article 37 § 1 (a) of the Convention. Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
