Application no. 864/13 Robert Mihai DRĂGUNĂ against Romania lodged on 13 December 2012
STATEMENT OF FACTS
The applicant, Mr Robert Mihai Dr ă gun ă , is a Romanian national, who was born in 1977. He is currently serving a prison sentence in the M ă rgineni Penitentiary .
The facts of the case, as submitted by the applicant, may be summarised as follows.
The applicant, sentenced on 27 June 2012 by the High Court of Cassation and Justice to seven years and six months ’ imprisonment, is currently serving his conviction in the M ă rgineni Penitentiary.
He states that the conditions of detention are inhuman and degrading due to overcrowding. He describes that he has to share a cell of 7 meters length and 5 meters width, which is insufficiently illuminated and ventilated , with other twenty-one inmates.
He also refers to the bad hygiene, namely that access to water is strictly limited, the inmates being allowed to have a shower only once a week and that the other sanitary installations function improperly. He also complains that the cell is infested with bedbugs and lice.
He also makes reference to the fact that during his detention he had been taken ill with diabetes and arterial hypertension, that the food provided is of poor quality and inadequate and that the medical treatment for the prior specified diseases is insufficient.
COMPLAINT
The applicant complains under Article 3 of the Convention about the inhuman and degrading conditions of detention, as described above, in the M ă rgineni Penitentiary .
QUESTIONS TO THE PARTIES
1. Has the applicant been subject, in breach of Article 3 of the Convention, to inhuman or degrading treatment in the M ă rgineni Penitentiar y ?
2. The Government are invited to provide information on the applicant ’ s detention conditions in the M ă rgineni Penitentiar y , in particular in connection with the cells where the applicant has been detained, stating particularly the number of beds and the number of persons being detained in the same cell with the applicant, but also the other material conditions of detention , such as the size of the cell, the number and size of the windows, the san itary installations available, the measures taken to ensure hygiene in the cells and in relation to the food provided.
