Resolution CM/ ResDH (2018)108 Execution of the judgments of the European Court of Human Rights 121 cases against Romania

(Adopted by the Committee of Ministers on 15 March 2018 at the 1310 th meeting of the Ministers’ Deputies)

The Committee of Ministers, under the terms of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Having regard to the final judgments transmitted by the Court to the Committee in these cases and to the violations established on account of overcrowding and poor material conditions in prison and police detention facilities and other dysfunctions regarding the protection of the prisoners’ rights (violations of Article 3);

Having regard also to the violations established in some cases related to ill-treatment by police and the lack of effective investigations and remedies in this regard; detention on remand; the fairness and length of criminal proceedings; the non-respect of the presumption of innocence; the lack of respect of private life, family life and the home and the ban on voting imposed automatically, prior to 2007, on convicted prisoners serving a prison sentence (violations of Article 3, Article 5, paragraphs 1, 3, 4 and 5, Article 6, paragraphs 1, 2 and 3 (c) , Articles 8 and 13 of the Convention and of Article 3 of Protocol No. 1);

Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required:

- of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ; and

- of general measures preventing similar violations;

Having invited the government of the respondent State to inform the Committee of the measures taken to comply with the above-mentioned obligation;

Having noted the information provided regarding the payment of the just satisfaction awarded by the Court;

Considering that the question of individual measures has been resolved, given that the applicants are no longer serving the sentences at the origin of the judgments of the European Court; that they no longer suffer the consequences of the violations established in respect of Articles 5, 6 (length of proceedings) and 8 of the Convention and of Article 3 of Protocol No. 1; that the domestic law allows for the reopening of criminal proceedings found by the Court to have been unfair and that the statutory limitation now precludes reopening the investigations into the ill-treatment suffered at the hand of the police;

Recalling that the question of the general measures required in response to the shortcomings found by the Court in the present judgments as regards the conditions of detention continues to be examined within the framework of the Bragadireanu v. Romania group of cases and that the closure of these cases therefore in no way prejudges the Committee’s evaluation of the general measures in relation to overcrowding and poor material conditions of detention or the protection of the other rights of the prisoners;

Recalling also that the general measures required in response to the other violations found in some of these cases are or were examined by the Committee in the cases or groups Barbu Anghelescu (No. 1) (Resolution CM/ ResDH (2016)150 ), Calmanovici (Resolution CM/ ResDH (2014)13 ), Creangă (Resolution CM/ ResDH (2013)220 ), Constantin and Stoian (Resolution CM/ ResDH (2013)40 ), Vlad and Others , Samoilă and Cionca (Resolution CM/ ResDH (2013)235 ), Varga (Resolution CM/ ResDH (2011)23 ) and Căşuneanu .

DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in these cases as regards the individual measures and

DECIDES to close the examination of these cases.
