SUBJECT MATTER OF THE CASE

The application concerns the alleged lack of fairness of the criminal proceedings against the applicant who was convicted for having committed a criminal offence of violent extortion of property belonging to others causing severe damage to the victim ’ s health, and sentenced to eleven years ’ imprisonment.

The applicant complains under Article 6 § 3 (d) of the Convention that despite his requests the victim was not heard in person either by the trial or the appellate courts.

QUESTIONS tO THE PARTIES

Did the applicant have a fair trial in the criminal proceedings against him, as required under Article 6 § 1 of the Convention? In particular, was he able to examine the victim before the trial panel that convicted him, as required by Article 6 § 3 (d) of the Convention?
