Application no. 22931/18 Andras KNOPP against Hungary lodged on 10 May 2018

SUBJECT MATTER OF THE CASE

The applicant is Hungarian national. Criminal proceedings are being conducted against him in the United States of America. Part of the information used by the US authorities in the proceedings was apparently gathered through secret surveillance, in particular phone tapping. The applicant fears that the Hungarian authorities, at the request of the US authorities, have recorded his phone conversations and surveyed his emails.

He asked the Hungarian Ministry of Justice to disclose the information gained through secret surveillance and advise him on the circumstances of ordering the surveillance.

His claim was ultimately dismissed by Kúria ; his constitutional complaint was to no avail.

QUESTION TO THE PARTIES

Does the Hungarian authorities ’ reluctance to give the applicant information on the measures of secret surveillance applied in his case amount to a violation of his rights under Article 8 of the Convention (see, mutatis mutandis , Szabó and Vissy v. Hungary , no. 37138/14 , §§ 52 to 89, 12 January 2016) ?
