SUBJECT MATTER OF THE CASE

The application concerns the abduction of a child by one of his parents and the non-execution of the judicial decisions ordering his return.

In this application t he applicant submitted her complaints relying on Articles 6, 8 and 13 of the Convent ion.

QUESTION tO THE PARTIES

Has there been a violation of the applicant ’ s right to respect for family life, contrary to Article 8 of the Convention? In particular, have the authorities observed their positive obligations under Article 8 to ensure that the applicant could properly exer cise the right of access to her child?
