SUBJECT MATTER OF THE CASE

The applicant is a citizen of Kazakhstan, who has lived in Russia since October 2018. The application concerns his detention between November 2019 and November 2020 pending readmission to Kazakhstan. Within seven months following his placement in the detention centre the applicant appealed against the removal decision claiming that his further detention absent his removal was illegal. Both the trial and appellate courts rejected the applicant ’ s claims. The appellate decision was adopted by the Kursk Regional Court on 10 September 2020.

QUESTION TO THE PARTIES

Has the applicant ’ s detention pending removal to Kazakhstan been lawful within the meaning of Article 5 § 1 (f) of the Convention?
