SUBJECT MATTER OF THE CASE
In application 48421/15 a teacher spoke in her class about the danger of HIV and gave an example of an HIV-positive woman, which the entire class immediately recognised as being the first applicant. Her daughter (the second applicant) was in that class and it was then when she also found out about her mother ’ s illness.
In application 56353/15 an investigator sought and obtained information from a medical institution about the applicant ’ s illness, which he claims had nothing to do with the criminal investigation in question.
The applicants complain about disclosure of sensitive medical data about them to third parties, who did not have a legitimate reason of obtaining it.
QUESTION TO THE PARTIES
Has there been a violation of Article 8 of the Convention? In particular, was sensitive medical data about each applicant (the second applicant ’ s mother in application no. 48421/15) disclosed to third parties (and to the applicant in application no. 48421/15)? (see P.T. v. the Republic of Moldova , no. 1122/12, 26 May 2020)
