DECISION

Application no. 65016/12 Mihály JANICS against Hungary (see appended table)

The European Court of Human Rights (Fourth Section), sitting on 21 June 2018 as a Committee composed of:

Vincent A. De Gaetano, President, Georges Ravarani, Marko Bošnjak, judges,

and Liv Tigerstedt, Acting Deputy Section Registrar ,

Having regard to the above application lodged on 4 October 2012,

Having regard to the observations submitted by the respondent Government,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant ’ s details are set out in the appended table.

The applicant was represented by Ms A. Kovács Zs., residing in Budapest.

The applicant ’ s complaints under Article 6 § 1 of the Convention concerning the excessive length of criminal proceedings were communicated to the Hungarian Government (“the Government”).

THE LAW

Complaints under Article 6 § 1 of the Convention

In the present application, having examined all the material before it, the Court considers that for the reasons stated below, the respondent Government cannot be held liable for a violation of Article 6 of the Convention in respect of the length of proceedings.

In particular, the Court notes that the proceedings lasted five years, nine months and fourteen days for two levels of jurisdiction. It is satisfied that, in the absence of any particular period of inactivity imputable to the authorities, this was not sufficiently lengthy to justify a finding that there has been a violation of Article 6 § 1 of the Convention.

It follows that the application must be rejected as manifestly ill-founded, pursuant to Article 35 §§ 3 (a) and 4 of the Convention.

For these reasons, the Court, unanimously,

Declares the application inadmissible.
