DECISION

Application no. 61857/16 Constantin LUNGU against Romania

The European Court of Human Rights (Fourth Section), sitting on 5 November 2020 as a Committee composed of:

Armen Harutyunyan , President, Jolien Schukking , Ana Maria Guerra Martins, judges,

and Liv Tigerstedt, Acting Deputy Section Registrar,

Having regard to the above application lodged on 6 February 2017 ,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr Constantin Lungu , was born in 1983.

The applicant ’ s complaints under Article 3 of the Convention concerning the inadequate conditions of detention were communicated to the Romanian Government (“the Government”).

On 10 July 2020, the Registry sent, by registered post, the Governments ’ observations to the applicant ’ s home address. The letter returned with a postmark indicating that the applicant had died. No heirs have presented themselves to the Court to pursue the application.

THE LAW

In the light of the foregoing, the Court considers that it is no longer justified to continue the examination of the application within the meaning of Article 37 § 1 (c) of the Convention.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.

Done in English and notified in writing on 26 November 2020 .
