Application no. 61157/15 O PELASGOS against Greece

The European Court of Human Rights (Third Section), sitting on 23 March 2023 as a Committee composed of:

and Viktoriya Maradudina, Acting Deputy Section Registrar,

Having regard to the above application lodged on 30 November 2015,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, O Pelasgos, is a housing association of school and nursery teachers established in 1978. It was represented by Mr G. Nikopoulos, a lawyer practising in Athens.

The applicant’s complaints under Article 1 of Protocol No.1 concerning the domestic courts’ decision that the applicant had not become the owner of land and was not entitled to an expropriation compensation as it had not acquired the property because the original predecessor-in-title itself had never acquired the property were communicated to the Greek Government (“the Government”).

On 6 February 2023 the applicant’s representative informed the Registry that the applicant wanted to withdraw the application to the Court as it no longer wished to pursue the case.

THE LAW

In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
