SUBJECT MATTER OF THE CASE

The case concerns the early termination of the applicant’s mandate of a Member of Parliament on the grounds of his withdrawal from the parliamentary faction of the political party, on the list of which he was elected.

QUESTION TO THE PARTIES

Has there been a breach of the applicant’s rights under Article 3 of Protocol No. 1? In particular, did the termination of his parliamentary mandate amount to a violation of his right to, once elected, sit as a member of the national legislature (see Paunović and Milivojević v. Serbia , no. 41683/06, § 58, 24 May 2016, with further references)?
