Having regard to the above application lodged on 4 October 2019,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The list of the applicants is set out in the appendix.

The applicants were represented by Mr A. Khalaf, a lawyer practising in Groningen.

The applicants applied for an interim measure under Rule 39 and complained inter alia under Articles 2 and 3 of the Convention about their expulsion to Greece.

On 17 October 2019 the Court decided to indicate to the Government of the Netherlands, under Rule 39 of the Rules of the Court, that the applicants should not be expelled to Greece and to give notice to the Government of the applicants’ complaints.

On 7 November 2019 the representative sent to the Court a completed application form.

On 13 December 2019 the Court extended the interim measure under Rule 39 of the Rules of Court until further notice.

The applicants’ complaints under Articles 2 and 3 of the Convention concerning their expulsion to Greece were communicated to the Dutch and Greek Governments, who submitted observations on the admissibility and merits. The observations were forwarded to the applicants, who submitted their own observations.

On 8 November 2022 the Dutch Government informed the Court that the decisions that formed the basis for the applicants’ expulsion to Greece had been withdrawn.

On 15 November 2022 the Registry sent a letter to the applicants requesting to inform the Court whether they wished to maintain their application in the light of the Dutch Government’s information. No reply was received to this letter.

By letter dated 19 December 2022, sent via the Court’s Electronic Communication Service (e-Comms), the applicants were notified that the period allowed for submission of their observations had expired on 13 December 2022 and that no extension of time had been requested. The applicants’ attention was drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. However, no response has followed.

THE LAW

In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application. Consequently, there is no need to uphold the indicated interim measure.

Accordingly, the interim measure should be lifted, and the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to lift the interim measure indicated under Rule 39 of the Rules of Court on 17 October 2019;

Decides to strike the application out of its list of cases.
