SUBJECT MATTER OF THE CASE

The applicant claims that the manner in which the use of special means of surveillance is regulated in Bulgaria does not ensure proper protection against arbitrary or abusive surveillance; that after November 2010 he was on several occasions subjected to secret surveillance; and that he did not have an effective remedy in that regard. He relies on Articles 8 and 13 of the Convention.

QUESTION TO THE PARTIES

Has there been a breach of the applicant’s rights under Article 8 of the Convention on account of the manner in which special means of surveillance are regulated in Bulgaria (see Ekimdzhiev and Others v. Bulgaria , no. 70078/12, §§ 247, 262-77 and 291-359, 11 January 2022)?
