Summary rejection of application for leave to appeal to the Court of Cassation: case referred to the Grand Chamber
The applicant, a civil servant in the Ministry of Education, lodged a complaint and a civil claim agains t her hierarchical superior, alleging perjury and defamation. Before the European Court she complained that insufficient reasons had been given for the decision whereby the public prosecutor had rejected her application for leave to appeal on points of law . In addition, she complained of the length of the proceedings.
The Court held by four votes to three that there had been no violation of Article 6 § 1 as regards the allegation that the proceedings had been unfair, and unanimously that there had been a vi olation of Article 6 § 1 as regards the length of the proceedings.
The case was accepted for referral to the Grand Chamber at the applicant's request.
