STATEMENT OF FACTS
The applicant, Mr Ioan Pandel , is a Romanian national, who was born in 1975 and lives in Satu Mare .
The facts of the case, as submitted by the applicant, may be summarised as follows.
At an unspecified date, the applicant was convicted for robbery and sentenced to three years and six months ’ imprisonment. He is currently serving his sentence at the Satu Mare Penitentiary.
The applicant affirms that the conditions of detention at Rahova Penitentiary, Aiud Penitentiary, Oradea Penitentiary, Gherla Penitentiary, B ârcea Mare Penitentiary and Satu Mare Penitentiary are inhuman and degrading and describes them as follows: ( i ) overcrowding (the applicant shared a cell of seven square meters with other ten detainees at Rahova Penitentiary, with other forty detainees at Aiud Penitentiary, and a room of ten square meters with other thirty persons at Bârcea Mare Penitentiar y ) ; (ii) the detainees have a possibility of taking a shower twice a week for one hour; (iii) the cells have one toilet, one outlet for fresh air, no heating and no hot water; (iv) the presence of cockroaches ( Oradea Penitentiary ), rats ( Gherla Penitentiary), bedbugs ( Satu Mare Penitentiary); (v ) the beds and mattresses are inadequate for sleeping as they are shredded and dirty; (vi) the food provided does not correspond to hygienic norms.
COMPLAINT
The applicant complains under Article 3 of the Convention about the inhuman and degrading conditions of detention in all the detention facilities in which he has so far been detained .
QUESTIONS TO THE PARTIES
1. Has the applicant been subjected, in breach of Article 3 of the Convention, to inhuman or degrading treatment in the Rahova Penitentiary, Aiud Penitentiary, Oradea Penit entiary, Gherla Penitentiary, Bâ rcea Mare Penitent iary and Satu Mare Penitentiary?
2. The Government are invited to provide information on the applicant ’ s detention conditions , in particular in connection with the material conditions of the cells where the applicant has been detained, namely the size of the cells , the number of beds , their quality, the number of persons being detained in the same cell with the applicant, the furniture and the sanitary facilities available in the cell and in the penitentiaries. The Government are also invited to provide information regarding the measures taken to provide hygienic conditions of detention, including but not limited to compliance with basic sanitary requirements for food, access to water, and shower rooms.
