Application no. 10633/15 Ivica TADIĆ against Croatia lodged on 23 February 2015

STATEMENT OF FACTS

The applicant, Mr Ivica Tadić , is a Croatian national, who was born in 1969 and is detained in Zagreb . He is represented before the Court by Ms L. Horvat , a lawyer practising in Zagreb .

The circumstances of the case

The facts of the case, as submitted by the applicant, may be summarised as follows.

On 28 July 2014 the applicant lodged a criminal complaint with the Zagreb Municipal State Attorney ’ s Office, against two police officers, V.B. and I.J.

The applicant alleged that V.B. and J.B. had, during his arrest, on 20 December 2012, forced him to the ground and then hit, kicked and verbally insulted him, owing to which he sustained gave injuries, such as broken arm and broken neck. The officers had then taken him to a police station where they continued to beat him. Only after three hours he had been taken to a hospital. The doctors had recommended an urgent surgery but the police officers had not allowed it. Instead, they had taken him back to the police station where they had continued to hit and insult him. In the evening he had been admitted to Zagreb Prison.

On 27 December 2012 the applicant was taken to the Zagreb Traumatology Hospital where he underwent a surgery and had an artificial shoulder implanted.

So far no decision or action has been taken by the prosecuting authorities.

COMPLAINT

The applicant complains under the substantive and procedural aspect of Article 3 of the Convention.

QUESTIONS TO THE PARTIES

1. Has the applicant been subjected to torture or inhuman or degrading treatment or punishment, in breach of Article 3 of the Convention?

2. Having regard to the procedural protection from ill- (see paragraph 131 of Labita v. Italy [GC], no. 26772/95, ECHR 2000-IV), was the investigation in the present case by the domestic authorities in breach of Article 3 of the Convention?
