Application no. 16284/13 Marian Teodor CIOBANU against Romania lodged on 28 February 2013

STATEMENT OF FACTS

The applicant, Mr Marian Teodor Ciobanu , is a Romanian national, who was born in 1977 and lives in Giurgiu .

A. The circumstances of the case

The facts of the case, as submitted by the applicant, may be summarised as follows.

The applicant has been convicted of driving without a valid licence and of outrage against public morals and disturbance of public order . He has been sentenced to four years imprisonment and is currently detained in the Giurgiu Prison.

The applicant describes the overall conditions of his detention in the Giurgiu Prison as being characterized by overcrowded cells and lack of hygiene (dirtiness, existence of bedbugs, other bugs and spiders).

COMPLAINT

The applicant complains in substance under Article 3 of the Convention about the conditions of his detention in the Giurgiu Prison .

QUESTION TO THE PARTIES

Were the conditi ons of detention during the applicant ’ s stay in the Giurgiu Prison in breach of the requirements of Article 3 of the Convention?

The Government are invited to provide information on the material conditions of the applicant ’ s detention in the Giurgiu Prison , in particular as regards the size and occupancy as well as the cleanliness of the cells in which he has been held.
