Application no. 56276/10 Augustin ROÅžIU against Romania lodged on 13 September 2010

STATEMENT OF FACTS

The applicant, Mr Augustin RoÅŸiu , is a Romanian national, who was born in 1974 and is, since 5 November 2007, serving a prison sentence in ColibaÅŸi Prison .

He describes as follows the conditions of his detention: he is held with five other inmates in a 4 sq. m cell and smokers are kept in same cells as non-smokers. The food in the prison canteen is not nourishing, and the tap water is not drinkable. The food items available for sale in the prison store are overpriced and usually expired. Although he is seriously ill (having suffered three stomach surgeries in 2009) he does not receive adequate food and his rights to receive parcel from home are abusively restricted by the prison administration. He also alleges lacking adequate medical assistance.

COMPLAINT

The applicant complains under Article 3 of the Convention about the conditions of detention in Coliba ÅŸ i Prison.

QUESTION TO THE PARTIES

1. Were the conditions of the applicant ’ s detention in Coliba ş i Prison in breach of the requirements of Article 3 of the Convention?

The Government are invited to provide information on the material conditions of the applicant ’ s detention and the situatio n of passive smoking in prison.
