SUBJECT MATTER OF THE CASE
The application concerns the manner in which the national courts applied the rules on the costs of proceedings so that the applicant who won a civil case had to pay to his opponent the costs in the amount which surpassed the compensation awarded to the applicant in connection with the injuries he sustained in a road accident.
QUESTIONS tO THE PARTIES
1. Did the applicant have a fair hearing in the determination of his civil rights and obligations, in accordance with Article 6 § 1 of the Convention? In particular, is the fact that the compensation awarded to the applicant in connection with a road accident was lower than the costs the applicant had to pay to the representation of the insurance companies in accordance with the general principle of fair trial?
2. Has there been a violation of the applicant ’ s right to the peaceful enjoyment of possessions, within the meaning of Article 1 of Protocol No. 1, as regards the above-mentioned decision on the costs of proceedings?
