SUBJECT MATTER OF THE CASE
The application concerns the conviction of the applicant for membership of the PKK, an illegal armed organisation , under Articles 220 § 6 and 314 of the Criminal Code and for resisting his arrest under Article 32 § 1 of the Marches and Demonstrations Act, on account of his participation in a demonstration. The first-instance court sentenced the applicant to six years and three months ’ imprisonment under Articles 220 § 6 and 314 of the Criminal Code. The court suspended the pronouncement of his conviction under Article 32 § 1 of the Marches and Demonstrations Act on condition that he did not commit another intentional offence for a period of five years. The applicant relies on Articles 6, 10 and 11 of the Convention.
QUESTION tO THE PARTIES
Has there been a violation of the applicant ’ s right to freedom of expression, contrary to Article 10 of the Convention, or his right to freedom of assembly, contrary to Article 11 of the Convention, on account of his convictions under Articles 220 § 6 and 314 of the Criminal Code and Article 32 § 1 of the Marches and Demonstrations Act?
