SUBJECT MATTER OF THE CASE
The application concerns the conviction of the applicant for membership of the TK İ P (Communist Workers ’ Party of Turkey), an illegal organisation under Articles 220 § 6 and 314 of the Criminal Code on account of the following acts: Organising and participating in demonstrations and other public gatherings in line with the will and the activities of TK İ P, disseminating propaganda in favour the TK İ P by way of selling newspapers and periodicals which share the ideology of that organisation and carrying out educational activities by way of organising meetings in houses to read and discuss books with a view to recruiting new members to TK İ P. The applicant was sentenced to six years and three months ’ imprisonment.
The applicant relies on Articles 7 and 10 of the Convention.
