SUBJECT MATTER OF THE CASE S

Ms Noé (application no. 66798/14), senior official of a registered left ‑ wing political party, performed propaganda activities in the street on 1 May 2012 while wearing a five-pointed red star. Having learnt that another party activist had been committed to the police for displaying a totalitarian symbol, the applicant demonstrated in front of the police building, claiming the release of the other activist. She was committed to the police station for about five hours and was later prosecuted for the offence of displaying a totalitarian symbol. Although the prosecution was subsequently discontinued, the applicant ’ s administrative action against the police for unjustified action was dismissed on 12 February 2014 (service: 4 April 2014).

Another similar incident occurred on 29 July 2012 when Ms Noé , together with Ms Vass (application no. 667 92/14) and Ms Róna (application no. 66889/14), demonstrated, wearing five-pointed red stars, against Government policies. Their cases challenging the ensuing police action were finally dismissed by the Kúria on various dates in February 2014 (service: 4, 9 and 7 April 2014, respectively).
