SUBJECT MATTER OF THE CASE
The applicant is a Turkish national who was born in 1968 and lives in Muş . The applicant was the head of the provincial branch of the Democratic Society Party ( Demokratik Toplum Partisi ) (DTP) in Muş , at the time of the events giving rise to the application. The application concerns criminal proceedings brought against the applicant for disseminating propaganda under section 7 § 2 of the Prevention of Terrorism Act (Law no.3713), on account of his statements that he made on ROJ TV, a Kurdish satellite television channel registered in and broadcast from Denmark, in which he allegedly praised a member of the PKK, an illegal armed organisation, and that member ’ s offences. At the end of the proceedings, he was convicted as charged and sentenced to a total of two years of imprisonment.
The applicant relies on Article 10 of the Convention.
