SUBJECT MATTER OF THE CASE

The applicants, Mr Sabahattin Y ı ld ı z , Mr Ramazan Bayram and Mr Murat Y ı ld ı z , are Turkish nationals who were born in 1986, 1964 and 1974 respectively and live in Adana. The application concerns the applicants ’ conviction for disseminating propaganda in favour of the PKK under section 7 § 2 of the Prevention of Terrorism Act (Law no. 3713) on account of their visit to the condolence tent of a deceased alleged member of the PKK, an illegal armed organisation. The applicants were sentenced to ten months ’ imprisonment each. The applicants rely on Articles 10 and 11 of the Convention.

QUESTION tO THE PARTIES

Has there been a violation of the applicants ’ right to freedom of expression, contrary to Article 10 of the Convention, or their right to freedom of assembly, contrary to Article 11 of the Convention, on account of their convictions under section 7 § 2 of the Prevention of Terrorism Act?
