STATEMENT OF FACTS

The application concerns a migrant Ivorian national, allegedly 17 years old, accommodated for about four months in the Red Cross reception Centre (Rome) and then in reception Centre for minors “Villa Spada ” (Rome).

QUESTIONS tO THE PARTIES

1. Has the applicant been subjected to inhuman or degrading treatment, during his stay at the Red Cross reception Centre in Rome, in breach of Article 3 of the Convention?

2. Was the applicant deprived of his liberty, in the reception Centre for minors “Villa Spada ” during the age assessment procedure, in breach of Article 5 § 1 of the Convention?

3. Has the applicant been denied the right to education, guaranteed by Article 2 of Protocol No. 1?

4. Has there been an interference with the applicant ’ s right to respect for his private life, within the meaning of Article 8 § 1 of the Convention? If so, was that interference in accordance with the law and necessary in terms of Article 8 § 2?

5 . Did the applicant have at his disposal an effective domestic remedy for his complaint under Article 3 of the Convention, as required by Article 13 of the Convention?
