Application no. 47292/14 Rikard KUNÅ TEK against Croatia lodged on 23 June 2014

SUBJECT MATTER OF THE CASE

The application concerns disciplinary proceedings against the applicant, a former judge, which resulted in his removal from judicial office for driving under the influence of alcohol and resisting and offending police officers who had pulled him over. The applicant complains under Article 6 § 1 of the Convention that the Constitutional Court examined only one out of three timely appeals lodged in his name (two were lodged by the applicant himself and the remaining one by his legal representative) against the decision of the National Judicial Council of 8 March 2012 whereby he was removed from judicial office.

QUESTIONS tO THE PARTIES

1. Did the Constitutional Court decide on all three appeals lodged in the applicant ’ s name against the National Judicial Council ’ s decision of 8 March 2012 to remove him from judicial office?

2. In the negative, has there been a violation of the applicant ’ s right of access to court guaranteed by Article 6 § 1 of the Convention?
