SUBJECT MATTER OF THE CASE

The application concerns the alleged unlawfulness of the applicant ’ s detention under Article 5 § 1 of the Convention.

The applicant complains that his arrest and detention were unlawful and lasted for about 7-8 hours which is in excess of 3 hours limit time allowed by the domestic legislation for detention without a court order.

QUESTION tO THE PARTIES

Was the applicant deprived of his liberty in breach of Article 5 § 1 of the Convention? In particular, did the deprivation of liberty fall within the paragraphs of that provision? Was a detention record ever compiled? If it was, the Government are requested to submit a copy of it, as well as any other documents related to the applicant ’ s detention.
