THIRD SECTION
Application no. 58172/14 Natalya Nikolayevna GONCHARUK against Russia lodged on 1 August 2014
SUBJECT MATTER OF THE CASE
The applicant ’ s daughter had committed suicide. In the course of a preliminary inquiry investigating authorities attempted to locate the applicant and notify her of the incident. As those attempts had proven to be fruitless, the daughter body was buried as unclaimed.
Subsequently, the applicant initiated civil proceedings seeking compensation for pecuniary and non-pecuniary damage. Her claims were dismissed. She appealed to no avail.
The applicant complained to the Court that domestic authorities had failed to undertake reasonable practical efforts in order to locate her and notify of her daughter ’ s death.
QUESTION tO THE PARTIES
Given the fact that the applicant was not promptly informed of her daughter ’ s death, has there been a violation of the applicant ’ s right guaranteed under Article 8 of the Convention?
