SUBJECT MATTER OF THE CASE
These fifteen applications concern complaints under Article 3 of Protocol No. 1 to the Convention as a result of the impossibility for the applicants to vote in different legislative elections – in particular, in the elections for Bulgarian Parliament held on 26 March 2017 and the elections for European Parliament held on 26 May 2019 – because they were convicted prisoners effectively serving their sentences at the time the elections were held.
QUESTION TO THE PARTIES
Has there been a breach of the applicants ’ right under Article 3 of Protocol No. 1 to the Convention to vote in free elections which ensure the free expression of the opinion of the people in the choice of legislature (see Kulinski and Sabev v. Bulgaria , no. 63849/09 , §§ 10–22, 21 July 2016 and, also, Anchugov and Gladkov v. Russia , nos. 11157/04 and 15162/05, 4 July 2013 and Resolution CM/ ResDH (2019)240 in respect of related developments), as regards the election for Bulgarian Parliament held on 26 March 2017 in respect of the applicants in the first to the eleventh applications (see appendix), and as regards the election for European Parliament held on 26 May 2019 in respect of the applicants in the first, twelfth, thirteenth, fourteenth, and fifteenth applications?
