SUBJECT MATTER OF THE CASE

The applicant was found guilty of unregistered taxi transport activity in summary minor offence proceedings. He complains under Article 6 §§ 1 and 3 (c) and (d) of the Convention that he had been tried in summary proceedings in which he was unable to challenge evidence or confront witnesses against him, who had been heard before another court in the absence of the defence.

QUESTION TO THE PARTIES

Did the applicant have a fair hearing in the determination of the criminal charges against him, in accordance with Article 6 § 1 of the Convention? In particular, were his rights to defend himself in person and to cross-examine witnesses secured in the summary minor-offence proceedings against him, as required by Article 6 §§ 1 and 3 (c) and (d) of the Convention (cf. Marčan v. Croatia , no. 40820/12 , 10 July 2014) ?
