SUBJECT MATTER OF THE CASE

The application concerns civil proceedings where the Supreme Court first allowed an appeal on points of l aw by the applicant ’ s opponent – which resulted in the decision on costs being overturned in the applicant ’ s disfavour – and then, later in the proceedings, declared such an appeal by the applicant inadmissible due to the change in case-law to the effect that such appeals against decisions on costs were no longer admissible.

QUESTIONS TO THE PARTIES

Has there been a breach of the principle of equality of arms and/or a violation of the applicant ’ s right of access to a court, contrary to Article 6 § 1 of the Convention, on account of the fact that the Supreme Court first allowed an appeal on points of law by the opposing party – which resulted in the decision on costs being overturned in the applicant ’ s disfavour – and later in the proceedings, declared such an appeal by the applicant inadmissible due to the change in case-law to the effect that such appeals against decisions on costs were no longer admissible?
