Refusal by President of Poland to appoint judges proposed by National Legal Commission and lack of related judicial remedies: communicated

The applications concern an unreasoned refusal by the President of Poland, in 2008 and 2016 depending on the individual applicants, to appoint them to vacant judicial posts in various courts across the country, even though their applications for the posts had been approved by the National Council of the Judiciary. The administrative courts, and then – in the case of some of the applicants – the Constitutional Court, successively declined jurisdiction.
