DECISION

Applications nos. 31496/21 and 31704/21 Perica MANOJLOVIĆ against Serbia and Novica NEŠIĆ against Serbia

The European Court of Human Rights (Second Section), sitting on 7 April 2022 as a Committee composed of:

Jovan Ilievski, President, Gilberto Felici, Diana Sârcu, judges,

and Viktoriya Maradudina, Acting Deputy Section Registrar,

Having regard to the above applications lodged on 14 June 2021,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The list of applicants is set out in the appended table.

The applicants were represented by Mr R. Kojić, a lawyer practising in Belgrade.

The applicants’ complaints under Article 6 § 1 of the Convention and Article 1 of Protocol No. 1 concerning the non-enforcement or delayed enforcement of domestic decisions given against a socially/State-owned company were communicated to the Serbian Government (“the Government”).

THE LAW

Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision.

After the present applications were communicated to the Government, the applicants’ representative notified the Court that the applicants had died after having signed the authority forms but before the applications had been lodged on their behalf (the relevant dates are set out in the appended table).

In view of the fact that the applicants’ representative has not provided valid authority forms, the applications are incompatible ratione personae with the provisions of the Convention within the meaning of Article 35 § 3 and must be rejected in accordance with Article 35 § 4 of the Convention.

For these reasons, the Court, unanimously,

Decides to join the applications.

Declares the applications inadmissible.

Done in English and notified in writing on 5 May 2022.
