Application no . 6743/08 Aleksandr Vladimirovich ZUBAREV against Russia
The European Court of Human Rights (First Section), sitting on 17 September 2013 as a Committee composed of:

Having regard to the above application lodged on 26 December 2007,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Aleksandr Vladimirovich Zubarev, is a Russian national, who was born in 1970 and is serving a prison sentence in Samara Region.
The Russian Government (“the Government”) were represented by Mr G. Matyushkin, Representative of the Russian Federation at the European Court of Human Rights.
The applicant complained, inter alia , under Article 3 of the Convention about the conditions of his detention.
On 30 August 2010 the application was communicated for observations to the Government who were invited to submit them by 17 January 2011.
On 20 December 2010 the applicant informed the Court, without giving any reason, that he no longer wished to pursue his application.
THE LAW
In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court unanimously
Decides to strike the application out of its list of cases.
