DECISION
Application no . 13454/13 Zoran KOLEV against Slovenia
The European Court of Human Rights ( Fifth Section ), sitting on 10 June 2014 as a Committee composed of:

Having regard to the above application lodged on 6 February 2013 ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Zoran Kolev , is a Macedonian national, who was born in 1963 and lives in Ljubljana .
The Slovenian Government (“the Government”) were represented by their Agent, Mrs N. Pintar Gosenca .
The Macedonian Government were informed of their right to intervene (Article 36 § 1 of the Convention and Rule 44 § 1 of the Rules of Court), however they did not avail themselves of that right.
The applicant complained under Article 3 of the Convention about the material conditions of detention in the remand section of Ljubljana Prison and under Article 13 of the Convention about the lack of an effective domestic remedy in that regard.
A fter the Government had been given notice of the application, t he applicant informed the Court that he wished to withdraw his applicat ion introduced before the Court, as he will institute proceedings against the Republic of Slovenia at the domestic level.
THE LAW
In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
