DECISION

Application no . 11605/07 Makbule ÖNAL and others against Turkey

The European Court of Human Rights (Second Section), sitting on 19 September 2017 as a Committee composed of:

Julia Laffranque, President, Paul Lemmens, Valeriu Griţco, judges, and Hasan Bakırcı, Deputy Section Registrar ,

Having regard to the above application lodged on 12 March 2007,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicants, who are Turkish nationals, were represented before the Court by Ms Eren Öztürk, a lawyer practising in Kocaeli. The details of the applicants are set out in the appendix.

The applicants ’ complaints under Articles 6, 13 of the Convention and Article 1 of Protocol No. 1 to the Convention were communicated to the Turkish Government (“the Government”), who were represented by their Agent.

The Registry ’ s letter of 11 January 2017, sent to the applicants ’ representative was returned, as the representative had moved from the address that had been indicated in the application form. No new address was provided to the Court despite the clear obligation to this effect, provided for by Rule 47 § 7 of the Rules of the Court.

THE LAW

The Court considers that, in the given circumstances, the applicants may be regarded as no longer wishing to pursue their application, within the meaning of Article 37 § 1 (a) of the Convention. Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and its Protocols which require the continued examination of the case.

In view of the above, it is appropriate to strike the case out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
