SUBJECT MATTER OF THE CASE
The applicants are a father, his daughter, born in 2006, and the paternal grandparents of the child. The application concerns the alleged infringement of the applicants ’ right to respect for their private and family life insofar as they cannot effectively implement, even with the assistance of the authorities, the court judgments dated 12 March 2014 and 17 April 2014 giving them contact rights. In May 2015, the first applicant initiated proceedings for custody review before the Sofia District Court. The first hearing was held on 18 May 2016. The proceedings are still pending.
QUESTIONS tO THE PARTIES
1. Has there been a violation of the applicants ’ right to respect for their private and family life, contrary to Article 8 of the Convention, in so far as they allege that the contact rights are not implemented in accordance with the judgments adopted on 12 March 2014 and on 17 April 2014 by the Sofia District Court, the custody review proceedings are lengthy and the Sofia District Court refused to examine the first applicant ’ s request for interim measures in those proceedings? In particular, have the Bulgarian authorities taken all measures that could reasonably be expected of them to ensure that a fair balance was struck between the various interests involved?
2. Did the applicants have at their disposal an effective domestic remedy for their complaint under Article 8, as required by Article 13 of the Convention?
