The European Court of Human Rights (Fourth Section), sitting on 11 March 2021 as a Committee composed of:

Armen Harutyunyan, President, Jolien Schukking , Ana Maria Guerra Martins, judges,

and Viktoriya Maradudina, Acting Deputy Section Registrar,

Having regard to the above application lodged on 11 June 2018 ,

Having regard to the parties ’ confirmation that a friendly settlement has been reached,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant ’ s details are set out in the appended table.

The applicant was represented by Ms S. Malik of Leigh Day Solicitors, based in London.

The applicant ’ s complaint under Article 5 § 1 of the Convention concerning his deprivation of liberty in Iraq in the period between 12 and 22 February 2007 was communicated to the United Kingdom Government (“the Government”) .

By joint letter dated 22 January 2021, the parties informed the Court that a friendly settlement had been reached. According to the terms of the settlement, the Government agreed to pay to the applicant the sum indicated in the appended table in full and final settlement of all his claims against the respondent State and without any admission of wrongdoing or liability.

The amount will be payable within three months from the date of notification of the Court ’ s decision. The payment will constitute the final resolution of the case.

THE LAW

The Court takes note of the friendly settlement reached between the parties. It is satisfied that the settlement is based on respect for human rights as defined in the Convention and the Protocols thereto and finds no reasons to justify a continued examination of the application.

In view of the above, it is appropriate to strike the case out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases in accordance with Article 39 of the Convention .

Done in English and notified in writing on 1 April 2021 .
