DECISION

AS TO THE ADMISSIBILITY OF

Application no. 48498/99 by Yuriy TAYKOV against Russia

Having regard to the above application introduced on 6 January 1999 and registered on 1 June 1999,

Having regard to the applicant’s letter of 4 February 2000 whereby he expressed his wish to withdraw the application,

Having deliberated, decides as follows:

THE FACTS

The applicant is a Russian national, born in 1931 and living in Ivanovo .

The applicant complained that since 1995 he had received his old-age pension not in due time. His actions against the social security authorities in connection with the delays in his pension payments were dismissed by the courts.             

THE LAW

By letter of 4 February 2000 the applicant stated that he wished to withdraw the above application on the ground that it had been settled. The applicant enclosed a copy of a friendly settlement agreement of 4 February 2000 signed by himself and the representative of the pension authorities. According to the agreement, the authorities undertook to pay the applicant 93,898 Russian roubles (RUR) in connection with the delays in his pension payments from August 1995 to August 1999, whereas the applicant waived his legal claims in regard to the above delays.

The Court takes note of the applicant’s wish to withdraw the application on the ground that the matter has been resolved. By reference to Article 37 § 1 of the Convention, the Court considers that the case should be struck out of its list of cases.

For these reasons, the Court, unanimously,

DECIDES TO STRIKE THE APPLICATION OUT OF ITS LIST OF CASES .
