FIRST SECTION

Application no. 8679/21 Orkhan SAFAROV against Azerbaijan lodged on 25 January 2021 communicated on 1 February 2024

SUBJECT MATTER OF THE CASE

The application concerns the criminal proceedings against the applicant who was convicted under Article 177 (theft) of Criminal Code and was sentenced to three years and three months’ imprisonment.

The applicant alleges that the criminal proceedings against him had been unfair since the domestic courts did not consider and grant his requests regarding the examination of witnesses whose attendance and statements would have a decisive impact on the result of the proceedings.

QUESTIONS TO THE PARTIES

Did the applicant have a fair trial in the criminal proceedings against him, in accordance with Article 6 § 1 of the Convention? In particular, was the applicant able to examine witnesses against him and to obtain the attendance of witnesses on his behalf, as required by Article 6 § 3 (d) of the Convention?
