FIRST SECTION
Application no. 45513/21 Barnabás PIPA against Hungary lodged on 7 September 2021 communicated on 20 September 2023
SUBJECT MATTER OF THE CASE
The applicant complains under Article 8 of the Convention about the loss of contact with his son due to the alleged failure of the domestic courts to conduct, in a fair and expeditious manner, the proceedings on parental supervision and contact rights. It appears that the applicant does not have a meaningful contact with his son since July 2018.
QUESTIONS TO THE PARTIES
1. Has there been a violation of the applicant’s right to respect for his family life, contrary to Article 8 of the Convention? In particular, have the authorities observed their positive obligations under Article 8 to ensure that the applicant could properly exercise his right of access to his child ( Ónodi v. Hungary , no. 38647/09, §§ 29-33, 30 May 2017)?
2. The parties are invited to inform the Court about any developments of the case since the submission of the application, and to submit copies of all relevant documents pertaining to the proceedings on the applicant’s contact rights.
3. The applicant is invited to detail the nature and regularity of his contact with his son prior to the initiation of the court proceedings on parental supervision and contact rights and afterwards.
