DECISION
Application no. 3458/19 Artur KOWALSKI against Poland

Having regard to the above application lodged on 9 January 2019,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Artur Kowalski, was born in 1971.
The applicant was represented by Mr T. Bosakowski, a lawyer practising in Gliwice.
The applicant’s complaints under Article 6 § 1 of the Convention about the excessive length of criminal proceedings, and under Article 13 of the Convention about the lack of redress for the excessive length of proceedings were communicated to the Polish Government (“the Governmentâ€).
On 13 July 2021 the applicant’s representative informed the Registry that the applicant had died; he did not indicate that the applicant had had any heirs who would wish to pursue the application. On 2 September 2021 the Government invited the Court to strike the application out of the list of cases. The applicant’s representative failed to reply to the Registry’s letter asking him to comment on the Government’s request.
THE LAW
In the light of the foregoing, the Court concludes that the applicant’s heirs, if any, do not wish to pursue the application within the meaning of Article 37 § 1 (a) of the Convention.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
