DECISION

Application no. 35815/20 Oskar Wiktor MARTYNIUK against Poland

The European Court of Human Rights (First Section), sitting on 29 June 2023 as a Committee composed of:

Having regard to the above application lodged on 3 September 2020,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr Oskar Wiktor Martyniuk, was born in 1994.

The applicant’s complaints under Articles 3 and 8 of the Convention concerning the strip searches he had to undergo while imprisoned were communicated to the Polish Government (“the Government”).

The applicant failed to respond to the Registry’s communication letter of 2 November 2022. The Court’s letter was returned by the Zamość Prison with a note that the applicant had been released from detention on 9 December 2021. However, no other address was provided. In addition, the applicant in his application form has not provided the Court with any alternative contact details.

By the letter of 20 November 2020, the applicant was informed about his obligation to inform the Court about any change of his correspondence address and was warned that the failure to respond to the Court’s information requests may lead to his case being struck out of the list. However, no response has ever been received.

THE LAW

In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
