Application no. 41157/20 Muhammed Yasar ILHAN against Denmark

The European Court of Human Rights (Fourth Section), sitting on 29 June 2023 as a Committee composed of:

Having regard to the above application lodged on 8 September 2020,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant’s details are set out in the appended table.

The applicant was represented by Mr Eddie Omar Rosenberg Khawaja, a lawyer practising in Copenhagen.

The applicant’s complaint under Article 8 of the Convention concerning an order to expel him from Denmark was communicated to the Danish Government (“the Government”).

Subsequently, the parties informed the Court that by decision of 11 October 2022, the Supreme Court had revoked the expulsion order, and that consequently the applicant had regained his permanent residence permit in Denmark.

The Court notes in addition, that should the applicant have any claims for compensation relating to the expulsion order, which was subsequently revoked, he may raise them in civil proceedings.

THE LAW

In view of the above, the Court considers that the matter has been resolved within the meaning of Article 37 § 1 (b) of the Convention and that respect for human rights as defined in the Convention and the Protocols thereto does not require it to continue the examination of the application under Article 37 § 1 in fine (see, inter alia , F.G. v. Sweden [GC], no. 43611/11 , § 73, 23 March 2016 and A.J. v. Greece (dec.), 34298/18, § 50, 26 April 2022).

Accordingly, the application should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
