SUBJECT MATTER OF THE CASE

The application concerns the alleged breach of the applicant’s right to presumption of innocence owing to a sentence contained in a decision taken by the Public Prosecutor discontinuing the criminal proceedings that had been instituted against him.

Relying on Article 6 § 1 of the Convention, the applicant alleges the impugned sentence used by the Public Prosecutor voices the suspicion that he was involved in criminal activity, in spite of the discontinuation of the criminal proceedings in this regard.

QUESTION TO THE PARTIES

Was the applicant’s right to presumption of innocence, guaranteed by Article 6 § 2 of the Convention, breached by the statements made by the Public Prosecutor in his decision, notified on 13 April 2017, discontinuing the criminal proceedings at issue?
