FOURTH SECTION

Applications nos. 33770/18 and 33820/18 Răzvan-Lucian MURARI against Romania and Constantin LAZAR against Romania lodged on 9 July 2018 communicated on 14 March 2023

SUBJECT MATTER OF THE CASE

The applications concern the applicants’ pre-trial detention from 12 October 2017 to 6 April 2018, on suspicion of theft. The applicants complain under Articles 5 § 3 and 6 §§ 1 and 2 of the Convention that the measure lasted unjustifiably long and was not supported by relevant and sufficient reasons on the part of the domestic courts.

QUESTIONS TO THE PARTIES

1. Was the length of the applicants’ pre-trial detention in breach of the “reasonable time” requirement of Article 5 § 3 of the Convention?

2. Did the authorities provide relevant and sufficient reasons for the measure (see Simon v. Romania , no. 34945/06, §§ 35-36, 1 July 2014, and Haziyev v. Azerbaijan , no. 19842/15, §§ 37-41, 6 December 2018)?
