The European Court of Human Rights (Fourth Section), sitting on 9 March 2023 as a Committee composed of:

Having regard to the above application lodged on 3 June 2016,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Mr Bela Jurić, was born in 1976. He was represented by Mr V. Juhas Đurić, a lawyer practising in Subotica.

The applicant’s complaints under Article 6 §§ 1 and 3 of the Convention concerning the fairness of the criminal proceedings against him were communicated to the Serbian Government (“the Government”).

On 25 June 2022 the applicant’s representative informed the Registry that the applicant had died on 6 April 2018. On 8 September 2022 the applicant’s representative submitted that no successors could be identified and that the application to the Court would not be pursued.

THE LAW

In the light of the foregoing, the Court concludes that the applicant’s heirs, if any, do not wish to pursue the application within the meaning of Article 37 § 1 (a) of the Convention.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
