DECISION
Application no. 72453/12 Marian Edward WOŹNIAK and others against Poland
The European Court of Human Rights (First Section), sitting on 21 May 2019 as a Committee composed of:
Aleš Pejchal, President, Tim Eicke, Raffaele Sabato, judges,
and Renata Degener, Deputy Section Registrar ,
Having regard to the above application lodged on 2 November 2012,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
1. A list of the applicants is set out in the appendix.
2. The Polish Government (“the Government”) were represented by their Agent, Ms J. Chrzanowska, and subsequently by Mr J. Sobczak, of the Ministry of Foreign Affairs.
3. The applicants complained under Article 6 § 1 of the Convention that the court fees required from them for lodging an appeal against the first-instance judgment had been excessive and in effect had deprived them of the right to a court.
4. On 20 April 2016 the Court decided to give notice to the Government of the applicants ’ complaints detailed above.
5. On 23 January 2019 the applicants ’ representative informed the Court that the applicants wanted to withdraw the application.
THE LAW
6. In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.
In view of the above, it is appropriate to strike the case out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
