SUBJECT MATTER OF THE CASE
The applications concern the alleged failure by the domestic electoral commissions and courts to effectively examine the applicants’ complaints concerning various election irregularities which had allegedly taken place in the single-seat constituencies where they stood as candidates in the parliamentary elections of 9 February 2020. The applicants complain under Article 3 of Protocol No. 1 to the Convention and under Article 13 of the Convention.

1. Has there been a breach of the applicants’ right under Article 3 of Protocol No. 1 to participate in free elections which ensure the free expression of the opinion of the people in the choice of legislature? Did the process of examination by the domestic authorities of the applicants’ complaints offer sufficient safeguards against arbitrariness? Did such examination comply with the requirements of Article 3 of Protocol No. 1 to the Convention?
The parties are requested to provide detailed factual information, supported with relevant documents, concerning the election results in the electoral constituencies where the applicants stood as candidates.

Applications nos. 36497/20 ( Sadigli ), 39186/20 ( Aliyeva ), 42504/20 ( Bakhshaliyev ), 46165/20 ( Bagirov ), 52077/20 ( Khalilov ) and 199/21 ( Rahimov ): In connection with the above question concerning the complaint under Article 3 of Protocol No. 1 to the Convention, given that the Constitutional Court had approved the results of elections while the applicants’ individual appeals before the appellate court or the Supreme Court were pending, was the redress available to the applicants for challenging the election results before the higher domestic courts effective in practice?
3. All applications, except application no. 42569/20 ( Ibrahimli ): Did the applicants have at their disposal an effective domestic remedy for their complaints under Article 3 of Protocol No. 1, as required by Article 13 of the Convention?
